OFFICIAL CONTEST RULES

Contest submissions must be in English, comply with Official Contest Rules, meet all requirements called for in the Official Contest Rules and be original, FORMER and/or CURRENT STUDENT AND PARENT-LED WORK.

All nominees and nominators must reside in the state of Washington.

By submitting a nomination, nominators agree to be bound by the official rules and the decisions of the sponsor and official judges, which are binding and final in all matters relating to the contest.

 

CONTEST PERIOD:

September 1, 2023 – April 19, 2024

 

NOMINATION PERIOD:

January 1, 2024, 12:01AM PST and ends at 11:59PM PST on April 19, 2024.

Nominations may be postmarked no earlier than January 1, 2024. Any nominations postmarked later than March 31, 2024, will not be accepted for evaluation and judging.

 

ELIGIBILITY:

Previous nominees and previously named finalists are eligible for nomination each award year. Previous winners are not eligible for future nominations.

Nominations for this contest are accepted FROM:

WASHINGTON STATE RESIDENTS

  • That are current or former students of eligible educators (as described below); provided however, that a nomination created by a current or former student under the age of 18 years must be viewed, approved and submitted by said student’s parent or legal guardian, who shall be identified as the nominator of the nomination; or
  • That are the parent or legal guardian of current or former students of eligible educators (as described below)

 

Nominations will be accepted FOR educators, who meet all of the following eligibility requirements:

  • Current Whatcom County, WA public school educators from school districts named below;
  • Educators currently working a minimum of 20 hours per week in a teaching classroom; and
  • Educators currently living in the state of Washington

Educators must be employed in one of the following Whatcom County, Washington school districts: Bellingham, Ferndale, Blaine, Lynden, Meridian, Nooksack, Mt. Baker. 

Nominees may not nominate themselves or immediate family members (as defined below) or household members (as defined below).

 

SPONSOR:

Employees of Sponsor and any other organizations affiliated with the sponsorship, fulfillment, administration, prize support, or promotion of the contest and each of their respective parents, agents, affiliates, subsidiaries, and promotion agencies, and their immediate family members (regardless of where they reside) or household members, whether or not related, are not eligible to enter or win. “Immediate family members” shall mean spouses, parents, stepparents, children, stepchildren, siblings, stepsiblings, and their respective spouses. “Household members” shall mean people who share the same residence at least three months a year.

 

JUDGES:

Judges may not submit nominations. Further, each of the judges’ respective parents, agents, affiliates, subsidiaries, promotion agencies, and their immediate family members (regardless of where they reside) or household members, whether or not related, are not eligible to enter or win. “Immediate family members” shall mean spouses, parents, stepparents, children, stepchildren, siblings, stepsiblings, and their respective spouses. “Household members” shall mean people, whether or not related, who share the same residence at least three months a year.

Finalists will be contacted by Sponsor with requests to: a.) grant permission for the submitted eligible nomination to be posted on the contest website to include all materials, photos, videos, and voice renderings contained within; and b.) provide confirmation that the Released Parties (as defined below) are not responsible for any unauthorized use of nomination contents by third parties. Released Parties do not guarantee the posting of any nomination and reserve the right to remove any posted nomination for any reason and at any time.

By the nominator and the finalist agreeing to participate in the contest, both agree that the nomination and its contents conform to these official rules and that Sponsor, in its sole discretion, may disqualify any nomination for any reason, including if it determines, in its sole discretion, that a nominator, finalist or the content of a nomination fails to conform to these official rules in any way or otherwise contains unacceptable content as determined by Sponsor, in its sole discretion.

Nominations that are found to be generated by script, macro or other automated means or practices, or by any means which subvert the entry process will be void.

 

FINALIST JUDGING AND WINNER DETERMINATION:

All eligible entries received by Sponsor will be evaluated using the following criteria:

33.3% innovative teaching methods and practices, 33.3% impact on students, school and community, and 33.4% creativity in nomination.

All submitted nominations found to be compliant with the official rules of the contest will be deemed eligible for the contest. These eligible nominations will be evaluated by the Brown & Brown of Washington, Inc. Seattle executive leadership team. This team will choose five (5) contest finalists.

The five (5) chosen finalist nominations will then be evaluated by a separate panel of five (5) judges comprised of Whatcom County, Washington community leaders, who are not under the employ of Sponsor. The five (5) judges are to be selected by the Brown & Brown of Washington, Inc. Seattle executive leadership team and publicly identified after the nomination period has expired. This panel of judges will select one (1) contest winner from the five (5) previously determined finalists.

Sponsor reserves the right to advance less than and up to five (5) finalists to the final judging phase if, in its sole discretion, it does not receive a sufficient number above anticipated eligible and qualified nominations. Secondarily, Sponsor reserves the right to advance more than five (5) finalists to the final judging phase if, in its sole discretion, it receives a sufficiently greater number of anticipated eligible and qualified nominations.

One (1) finalist nomination will be deemed the potential award winner. In the event of a tie, the finalist panel of five (5) judges will determine the winner in question from among the tied entries based on the “innovative teaching methods and practices” criterion specified above. Decisions of the judges are final and binding in all respects. All results are unofficial until verified by Sponsor.

 

WINNER NOTIFICATION:

Contest winner will be notified via email and will be required to complete and return the following tax documentation within ten (10) business days of the date of notification or a runner-up may be selected for the applicable prize:

If such documents are not returned within the specified time, prize or prize notification is returned as undeliverable, and Sponsor is unable to contact any potential contest winner or any potential contest winner is not in compliance with these official rules, then the prize will be forfeited and, at Sponsor’s discretion, the runner-up may be selected for the applicable prize.

 

AWARD/PRIZE:

The retail value of the sole prize offered is $5,000.00 US dollars.

The name of the winner and prize won will be recorded and retained by Brown & Brown of Washington, Inc. 

One (1) award winner will receive two checks: 1.) a $2,500.00 check made payable to the contest winner’s School PTA for the contest winner’s sole professional use within his/her classroom, and 2.) a $2,500.00 check made payable to the contest winner for his/her sole personal use. Contest winner will have his/her story, likeness and winning nomination featured on https://bbrownexcellenceineducation.org and will appear in a promotional video for the promotion of said contest. Exact issue/date of prize award to be determined by Sponsor, in its sole discretion. 

Contest winner is responsible for all applicable federal, state, and local taxes, if any, as well as any other costs and expenses associated with prize acceptance and use not specified herein as being provided. All prize details are at Sponsor’s sole discretion. Released Parties (as defined below) disclaim all and any liability for the actual provision, quality or nature of any third-party product or service accepted by the winner. The awarding of any prize is contingent upon full compliance with these official rules.

With the exception of the nominations selected as finalists and the winning nomination, all submitted and eligible nominations will be retained for a maximum period of 90 days following the award of the prize to the contest winner; thereafter, such nominations will be destroyed. The nominations selected as finalists and the winning nomination may continue to be retained and utilized by Sponsor as provided by the official rules until such time that said finalist and winning nominations may be destroyed at Sponsor’s discretion.    

 

USE OF NOMINATIONS:

Nominator Consent and Release of Liability

By submitting a nomination, nominator consents, to the extent allowed by law, to release Sponsor and any other organizations affiliated with the sponsorship, fulfillment, administration, prize support, or promotion of the contest and each of their respective parents, agents, affiliates, subsidiaries, and promotion agencies, and each of their respective officers, directors, agents, independent contractors, representatives and employees, as well as each of their respective successors, representatives and assigns (collectively, the “Released Parties”) from any and all actions, claims, injury, loss or damage arising in any manner, in whole or in part, directly or indirectly, from participation in this contest.

By participating in this contest and submitting a nomination, nominator also consents to the use of nominator’s display name, avatar, photograph(s), likeness, statements, biographical information, voice and city and state address for promotional purposes for this contest and any future contest, and in perpetuity, in any and all forms of media, now known or hereafter devised without compensation, review or approval rights, notification or permission, except where prohibited by law. Nominator also grants the Released Parties a perpetual, royalty-free, non-exclusive, sub licensable, unconditional and transferable license to edit, modify, cut, rearrange, add to, delete from, reproduce, encode, store, modify, copy, transmit, publish, post, broadcast, display, adapt, exhibit and/or otherwise use or reuse the nomination, nominator’s name, photo, video, audio recording and biographical material including, but not limited to, all materials submitted in connection with the contest in any and all media, and in any manner, for promotional, or any other non-commercial purposes related to the contest without further review, notice, approval, consideration, or compensation to nominator or any third party, except where prohibited by law.

In addition to the rights of publicity consent and release of liability referenced hereinabove, a nominator, who is a parent/legal guardian that submits a nomination prepared by and on behalf of a current or former student under the age of 18 years, does hereby acknowledge and confirm that (a) said nominator has viewed the content of the nomination prepared by the student, and (b) gives consent to the utilization of the nomination by the Sponsor for purposes of this contest as described by the official rules.  

Finalist Consent and Release of Liability

Once notified and consenting to participation as a finalist, the finalist will be required, to the extent allowed by law, to release the Released Parties from any and all actions, claims, injury, loss or damage arising in any manner, in whole or in part, directly or indirectly, from participation in this contest and/or acceptance or use of any prize.

By participating in this contest, finalist also consents, to the extent required by law, to the use of finalist’s display name, avatar, photograph(s), likeness, statements, biographical information, voice and city and state address for promotional purposes for this contest and any future contest, and in perpetuity, in any and all forms of media, now known or hereafter devised without compensation, review or approval rights, notification or permission, except where prohibited by law.

Finalist also grants the Released Parties a perpetual, royalty-free, non-exclusive, sub licensable, unconditional and transferable license to edit, modify, cut, rearrange, add to, delete from, reproduce, encode, store, modify, copy, transmit, publish, post, broadcast, display, adapt, exhibit and/or otherwise use or reuse  the nomination, finalist’s name, photo, video, audio recording and biographical material including, but not limited to, all materials submitted in connection with the contest in any and all media, and in any manner, for promotional, or any other non-commercial purposes related to the contest without further review, notice, approval, consideration, or compensation to finalist or any third party, except where prohibited by law.   

Finalist consents that, from the date of notification by Sponsor of finalist’s status as a potential winner and continuing until such time when Sponsor informs finalist that finalist no longer needs to do so, finalist will make him or herself available to Sponsor for publicity and promotional activities related to the contest. Sponsor reserves the right to make public statements about the finalists and winner, on-air, on the Internet, or otherwise, prior to, during, or following a contest. The finalist, who is subsequently named the winner of the contest, consents that Sponsor may announce his/her name as the winner on-air or at any time in connection with the marketing and promotion of the contest.

For any contest finalist nomination selected by Sponsor that may contain the personal information and/or audio-visual recording of an identified/identifiable child (or children) under the age of 18 years, a separate parental consent and release form may be required for such child (or each of the children), as requested, and as required under law, before the nomination may be posted or published by the Sponsor.

For any contest finalist nomination selected by Sponsor that may contain images and/or an audio-visual recording in a school classroom, on school premises, or at a school-sponsored event or activity, a separate consent and release form may be required from the school, as required by law, before the nomination may be posted or published by the Sponsor.

 

PRIVACY:

When you register, we collect personally identifying information about you, including your name, complete mailing address, and email address. Your name, complete mailing address, and email address will not be sold or rented to third parties. MISCELLANEOUS:

Retail value of the sole prize offered: $5,000.00 US dollars.

Released Parties are not responsible for lost, late, incomplete, damaged, inaccurate, stolen, undelivered, garbled or misdirected entries, nominations or registrations; or for lost, interrupted or unavailable network, server, Internet Service Provider (ISP), website, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties, or other errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the contest, including, without limitation, errors or difficulties which may occur in connection with the administration of the contest, the processing of entries, the announcement of the prizes, or in any contest-related materials. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking or by any equipment or programming associated with or utilized in the contest. Released Parties are not responsible for injury or damage to participants’ or to any other person’s computer related to or resulting from participating in this contest or downloading materials from or use of the website. Sponsor reserves the right, in its sole discretion, to disqualify any person tampering with the entry process, the operation of the web site or otherwise in violation of these official rules. Sponsor further reserves the right, in its sole discretion, to cancel, terminate or modify this contest if the contest is compromised by virus, technical corruption, non-authorized human intervention, or any other causes which, in the sole discretion of the Sponsor, corrupt or affect the administration, security, fairness, proper play or integrity of the contest. Sponsor reserves the right, in its sole discretion, to disqualify any individual it believes has tampered with the entry process. In the event of cancellation or termination, Sponsor reserves the right to resubmit, for judge selection, five (5) finalists from among all eligible, non-suspect entries received prior to the date of cancellation or termination, using the judging and voting processes outlined above. In the event of a dispute regarding online entry, entry will be deemed made by the authorized account holder of the e-mail account associated with the entry and he/she must comply with these official rules. The authorized account holder is the natural person who is assigned the e-mail address by the Internet Service Provider (ISP), on-line service provider, or other organization responsible for assigning email addresses. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE THE WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR WILL DISQUALIFY ANY SUCH INDIVIDUAL AND RESERVES THE RIGHT TO SEEK DAMAGES (INCLUDING ATTORNEYS’ FEES) AND OTHER REMEDIES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.

Contest is subject to all applicable U.S. federal, state and local laws and regulations. Prize winners will be issued an IRS 1099-MISC tax form in the amount of the prize retail value as stated herein.
